This website, oyrolab.com, is owned and operated by OyroLab, a commercial entity registered in the Republic of Slovenia, European Union. 2. Product Classification and Regulatory Status

This section exists because mouth tape products occupy a regulatory space that consumers and regulators have raised questions about, and OyroLab is committed to full transparency about where OyroTape™ sits within EU product law.

OyroTape™ is classified as a personal care and general wellness consumer product. It is not classified as, and does not claim to be, a medical device under EU Medical Device Regulation (EU) 2017/745. It is not CE-marked as a medical device. It is not a medicinal product under EU Directive 2001/83/EC. It contains no active pharmaceutical ingredients.

Why does this distinction matter, and why is OyroLab being explicit about it?

EU MDR 2017/745 defines a medical device as a product intended for the diagnosis, prevention, monitoring, prediction, prognosis, treatment, or alleviation of disease or injury. OyroTape™ is not intended for any of these purposes. It is a personal care product that physically supports the lips in a closed position during sleep, encouraging nasal airflow for adults who already breathe freely through an unobstructed nasal passage. The science of nasal breathing — including well-documented benefits such as nasal nitric oxide production, air humidification, and improved sleep architecture — is established and referenced in peer-reviewed literature. However, OyroTape™ does not claim to treat any specific condition on the basis of this science.

Claims made on oyrolab.com about potential wellness benefits — improved sleep quality, reduced morning dry mouth, better recovery — are lifestyle and wellness claims based on commonly reported user experiences and the established physiology of nasal breathing. They have not been evaluated by the European Medicines Agency (EMA), the Slovenian Agency for Medicinal Products and Medical Devices (JAZMP), or any other regulatory authority for therapeutic accuracy, and no such evaluation is claimed.

OyroLab monitors the regulatory landscape continuously. Should the classification of mouth tape products change under any applicable EU or national regulatory framework, OyroLab will update its product positioning and disclosures accordingly and promptly.

3. Intellectual Property

All content published on oyrolab.com — including but not limited to the OyroLab brand name, the OyroTape™ product name, the OyroFlex™ material designation, all product descriptions, website design, layout, typography, product photography, written marketing copy, and technical specifications — is the exclusive intellectual property of OyroLab or its duly licensed suppliers and content partners.

These materials are protected under:

  • EU Directive 2001/29/EC on the harmonisation of copyright and related rights in the information society
  • Slovenian Copyright and Related Rights Act (Zakon o avtorski in sorodnih pravicah, ZASP)
  • EU Trademark Regulation (EU) 2017/1001
  • Applicable Slovenian and international trademark and intellectual property frameworks

The following are strictly prohibited without prior written authorisation from OyroLab:

  • Reproduction, copying, or redistribution of website content for any commercial purpose
  • Automated scraping, data-mining, or systematic extraction of content from oyrolab.com
  • Use of OyroLab's brand name, product names, or trademarks in any advertising, domain name, social media account, or commercial context in a manner that could create confusion or imply an unauthorised association
  • Creation of derivative works based on OyroLab's intellectual property without express written consent
  • Wholesale reproduction of product descriptions for use on competing listings or websites

The following are permitted without prior consent:

  • Genuine editorial reviews and journalistic commentary referencing OyroLab or OyroTape™ in a factually accurate and non-misleading manner
  • Non-commercial social media posts referencing the product based on personal experience
  • Brief quotation for informational or educational purposes with clear attribution

4. Advertising and Marketing Standards Compliance

All marketing and advertising conducted by OyroLab, whether on oyrolab.com or on third-party platforms, is produced in compliance with:

  • EU Directive 2005/29/EC on Unfair Commercial Practices (prohibiting misleading advertising, false claims, and aggressive commercial practices)
  • EU Directive 2006/114/EC on Misleading and Comparative Advertising
  • Slovenian Consumer Protection Act (ZVPot-1) provisions on advertising and unfair commercial practices
  • Platform-specific advertising policies of Meta, TikTok, Google, and any other channels used

OyroLab does not make unsubstantiated health or therapeutic claims in any marketing material. All performance claims are based on genuine customer experiences or well-established scientific literature on nasal breathing physiology, referenced and used responsibly. OyroLab clearly identifies all paid advertising, sponsored content, and influencer partnerships in accordance with applicable disclosure requirements under EU and Slovenian law.
