1. Introduction

These Terms of Service ("Terms") govern your access to and use of the oyrolab.com website and your purchase of products from OyroLab. By accessing this website, creating an account, or completing a purchase, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be legally bound by them.

If you do not agree to these Terms, you must not use this website or place any order. These Terms are written in plain language. Where legal references are made, they are included so that you can verify our obligations and your rights independently — not to obscure or complicate them.

2. Who We Are

OyroLab operates oyrolab.com as an e-commerce store selling personal care and wellness products. Our primary product, OyroTape™, is a hygiene-sealed mouth tape designed to support nasal breathing during sleep for healthy adults. OyroLab is registered and operates in Slovenia, European Union.

3. Eligibility

By using this website or placing an order, you represent and warrant that:

You are at least 18 years of age. OyroTape™ is not suitable for use by minors, and OyroLab does not knowingly sell to persons under 18.
You have the legal capacity to enter into a binding contract under the laws of your country of residence.
All information you provide during registration and checkout — including your name, address, and payment details — is accurate, complete, and current.
You are purchasing products for personal, non-commercial use, or as a gift for another adult who meets these eligibility requirements.

OyroLab reserves the right to refuse, cancel, or restrict orders where there are reasonable grounds to believe these conditions are not met, including cases of suspected fraud or misuse.

4. Product Descriptions, Accuracy, and Medical Disclaimer

OyroLab makes every reasonable effort to ensure that product descriptions, images, pricing, and specifications on the website are accurate and current. However, the following important limitations apply:

Product images are for illustrative purposes only. Minor variations in colour, texture, or packaging may occur due to screen calibration differences, photographic conditions, or packaging updates that have not yet been reflected on the website.

Product descriptions represent OyroLab's honest, best-faith account of OyroTape™'s characteristics and typical performance. They are wellness descriptions, not medical claims.

Most importantly: OyroTape™ is a general wellness product. It is not a medical device under EU Medical Device Regulation (MDR) 2017/745. It has not been CE-marked as a medical device, and it has not been evaluated by any regulatory health authority for therapeutic efficacy in diagnosing, preventing, treating, or curing any medical condition. No such claims are made.

Why does this matter? Because EU law draws a precise, meaningful distinction between:

General wellness products — items that support a healthy lifestyle without making specific therapeutic claims (OyroTape™ falls here)
Medical devices — products intended to diagnose, prevent, monitor, or treat specific medical conditions (subject to rigorous EU MDR approval processes)

OyroTape™ is sold as a personal care product that supports nasal breathing during sleep. Descriptions of associated wellness benefits — improved morning energy, reduced dry mouth, better sleep quality — reflect the commonly reported experiences of users and the well-established physiology of nasal versus oral breathing. They are not promises of specific medical outcomes.

OyroLab reserves the right to update product descriptions, formulations, or specifications without prior notice, provided any such change does not negatively affect orders already confirmed.

5. Pricing and Payment

All prices on oyrolab.com are displayed in Euros (EUR) and include applicable VAT where required by Slovenian and EU law. Shipping costs are shown separately at checkout and are included in the order total before payment confirmation. There are no hidden fees.

OyroLab reserves the right to change prices at any time. Price changes do not affect orders that have already been confirmed by dispatch.
In the event of a clear pricing error on the website (for example, a product listed at an obviously incorrect price due to a technical fault), OyroLab reserves the right to cancel the affected order and issue a full refund, notifying the customer promptly and in writing.
Payment is collected at the time of order placement. OyroLab accepts most major credit and debit cards, PayPal, Apple Pay, Google Pay, Klarna, and other methods displayed at checkout.
OyroLab does not store full payment card details. All payment data is handled by PCI DSS-compliant third-party processors.
OyroLab does not charge additional fees for using specific payment methods.

6. Order Placement and Contract Formation

Understanding when a legally binding contract is formed protects both parties. The process works as follows:

You add products to your cart and proceed to checkout
You provide your delivery address, contact details, and payment information
You review the complete order summary, including total price and shipping costs
You submit your order by confirming payment
OyroLab sends an automated order confirmation email — this is an acknowledgement of receipt, not a binding acceptance
A binding contract is formed when OyroLab dispatches your order and sends a dispatch confirmation email with tracking details

Why does contract formation happen at dispatch and not at order placement? Because between order placement and dispatch, OyroLab must verify payment, check stock availability, and confirm the order can be fulfilled as described. If a product becomes unexpectedly unavailable after you order, OyroLab can cancel the order and issue a full refund without being in breach of contract. This is standard EU e-commerce practice and protects you from being charged for goods that cannot be supplied.

OyroLab reserves the right to decline any order before dispatch. Reasons may include payment failure, product unavailability, suspected fraudulent activity, or inability to deliver to the specified address. Any payment taken will be fully and promptly refunded in such cases.

7. Product Use, Safety Conditions, and Your Responsibilities

OyroTape™ is a personal care product applied to the face during sleep. The safety conditions below are binding and must be observed. They are not precautionary boilerplate — they reflect genuine clinical considerations supported by medical literature.

OyroTape™ must only be used by individuals who:

Are aged 18 or over
Can breathe freely and unobstructedly through both nostrils without effort
Are not under the influence of alcohol, sedatives, sleep medication, or any substance that impairs consciousness or physical reflexes
Do not have, or have not been diagnosed with, any of the following: nasal congestion, a deviated septum, nasal polyps, chronic rhinitis, sinusitis, obstructive sleep apnoea (OSA), or any other condition that impairs nasal airflow

Why are these conditions so important? Medical literature — including a 2023 systematic review published by researchers at Western University in Canada and a JAMA editorial — has identified that taping the mouth of a person whose nasal airway is partially or fully obstructed can cause dangerous drops in blood oxygen levels during sleep. The compensatory mechanism of mouth breathing, which the body uses when the nose is blocked, is removed by the tape. For a person who breathes normally through an unobstructed nose, this risk does not apply. OyroTape™ is designed for healthy nasal breathers, not for people who breathe through their mouth out of physiological necessity.

Consult your doctor before use if you have any health condition, take regular medication, are pregnant, have any concerns about your breathing or sleep health, or are unsure whether OyroTape™ is appropriate for you.

Discontinue use immediately and seek medical advice if you experience restricted breathing, skin irritation, heightened anxiety, or any adverse reaction while using OyroTape™.

By purchasing and using OyroTape™, you confirm that you have read and understood these safety conditions, that you meet the eligibility criteria, and that you accept full personal responsibility for your decision to use the product in accordance with these instructions.

8. Limitation of Liability

To the fullest extent permitted by EU Consumer Rights Directive 2011/83/EU and Slovenian consumer protection law:

OyroLab's total liability to any customer for any claim arising from a purchase shall not exceed the total amount paid by that customer for the relevant order.
OyroLab shall not be liable for indirect, incidental, consequential, or punitive damages — including but not limited to loss of income, loss of data, or personal injury — arising from the misuse of OyroTape™ outside the conditions of use specified in these Terms and on the product packaging.
OyroLab does not exclude or limit liability for: death or personal injury caused by OyroLab's own negligence; fraudulent misrepresentation; or any other liability that cannot lawfully be excluded under EU or Slovenian law.
Nothing in these Terms affects your statutory rights as a consumer under EU law or Slovenian national consumer protection legislation. Your statutory rights exist independently of anything in these Terms and cannot be waived or excluded by contract.

9. Intellectual Property

All content on oyrolab.com — including the OyroLab brand name, OyroTape™ and OyroFlex™ trademarks, product descriptions, website design, photography, and marketing materials — is the exclusive intellectual property of OyroLab or its licensed suppliers, protected under EU and Slovenian intellectual property law.

You may not reproduce, copy, distribute, or create derivative works from any OyroLab intellectual property without prior written consent. Genuine editorial reviews, factually accurate social media posts referencing the product, and non-commercial informational use are permitted provided OyroLab's identity and products are not misrepresented.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Slovenia and, where applicable, the European Union. In the event of a dispute, we ask that you contact us first at shop@oyrolab.com — we resolve the vast majority of issues directly and promptly.

If a dispute cannot be resolved directly, you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Slovenian consumers may also contact the Tržni inšpektorat RS (Market Inspectorate). OyroLab submits to the jurisdiction of the competent courts of the Republic of Slovenia.

11. Modifications

OyroLab may update these Terms at any time to reflect changes in law or business operations. Updated Terms will be published on oyrolab.com with a revised effective date. Continued use of the website after publication of updated Terms constitutes acceptance. For significant changes, OyroLab will notify registered customers by email where reasonably practicable.
